Terms of Service

1. Acceptance of Terms

By accessing or using Galaxy Nexus services, you accept and agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree to these terms, you may not use our services.

2. Service Description

Galaxy Nexus provides web hosting, game server hosting, Discord bot hosting, virtual private servers (VPS), and dedicated server services. VPS access is granted only after a manual screening application and may be revoked if the actual use diverges from the approved use case. All services are subject to availability and these terms.

3. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate and complete registration information
• You are solely responsible for all activities under your account
• You must notify us immediately of any unauthorized use of your account
• For VPS, the use case you describe in your access application must remain accurate for the life of the service

4. Acceptable Use

• No illegal activities or content violating Australian law
• No spam, phishing, or unauthorized bulk communications
• No network abuse, DDoS attacks, or hacking attempts
• No copyright or trademark infringement
• No adult content unless legal in Australia and restricted to audiences verified as 18+
• No cryptocurrency mining without written consent

5. Payment and Billing

• Services are billed in advance on a monthly or hourly basis
• All prices are in Australian Dollars (AUD) unless otherwise specified
• GST may apply to Australian customers as required by law
• Services may be suspended for non-payment
• Refunds are available within 72 hours of first payment for new accounts

6. Service Level Agreement

We guarantee 99.9% uptime for our infrastructure. Service credits may be provided for verified outages exceeding this threshold, subject to the Service Level Agreement. Credits are limited to 100% of monthly service fees and must be requested within 14 days of the incident.

7. Data and Backups

• You are responsible for maintaining backups of your data
• We perform regular backups but cannot guarantee data recovery
• Backups are retained for 7 days unless otherwise agreed
• Data may be deleted upon service termination

8. Limitation of Liability

Galaxy Nexus shall not be liable for any indirect, incidental, special, or consequential damages. Our maximum liability shall not exceed the fees paid in the 12 months preceding the claim. Nothing in these Terms limits any right you have under the Australian Consumer Law, including consumer guarantees, to the extent those rights cannot lawfully be excluded or limited by contract.

9. Termination

• Either party may terminate services with 30 days written notice
• We may terminate immediately for violations of these terms
• VPS access may be suspended or revoked if actual usage diverges from the approved application use case
• Terminated accounts are subject to data deletion policies
• Outstanding fees remain due upon termination

10. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in the courts of Brisbane, Queensland.

11. Changes to Terms

We may modify these terms at any time. Continued use of services after changes constitutes acceptance of new terms. Material changes will be notified via email.
